Under the new delegation statutes passed by the Florida Legislature in 2020, registered nurses (RNs) will be subject to increased liability. The new Agency for Health Care Administration (AHCA) regulations will affect providers of all types, but home care is unique in that caregivers work independently. The following are draft versions of how AHCA proposes to implement the statute:

  • Rule 59A-8.0095 establishes training, delegation of tasks, and supervisory requirements for home health aides and certified nursing assistants (CNAs); aligns requirements for alternate administrators with administrators and alternate director of nursing with director of nursing; and requires submission of the license application form to report certain personnel changes.
  • Rule 59A-8.0097 establishes training and validation requirements for home health aides and CNAs.
  • Rule 59A-8.0216 establishes criteria for the delegation of tasks by an RN and supervisory requirements for home health aides and CNAs.
  • Rule 59A-8.0219 establishes procedures for the administration of medication by home health aides and CNAs to home health agency patients.

She was admitted to the bars in both Florida and California and a member of American Health Lawyers Association, Florida Bar (Health Law Section), Florida Bar (Business Law Section) and Florida Bar (Real Property Probate Law).
