AHCA Announces Home Health Workshops This Spring

On March 24, 2021, the Agency for Health Care Administration (AHCA) announced the following upcoming industry-relevant rulemaking workshops that will take place via conference call. HCAF staff will be in attendance.

Licensure Application Process (59A-35.060)

The purpose of this workshop is to incorporate all licensure application forms into the rule. Currently, some licensure applications are incorporated within Rule Chapter 59A-35 and other program-specific rule chapters. Placing all the application forms into one rule chapter will enable AHCA to make uniform changes more effectively, assist consumers to easily find licensure application forms in rule, and allow AHCA to revise application forms at one time within one rule chapter. In addition, revised licensure application forms for nursing homes, assisted living facilities, home health agencies, and companion services or homemaker services providers will include a direct care workforce survey in accordance with 408.822, F.S. Exemption from Licensure as a Home Health Agency (59A-8.005)

The purpose of this workshop is to update the application for exemption with two new exemptions, which include persons or entities providing skilled therapy services or providing services through volunteers or relatives of the patient. Click here to view the notice.

Home Health Agency Personnel (59A-8.0095)

The purpose of this workshop is to amend the rule to align the requirements for an administrator and alternate administrator as well as a director of nursing and an alternate director of nursing. Additionally, the rule is amended to require submission of the license application form for reporting certain personnel changes. Language is amended to clarify the delegation of tasks and supervisory requirements for home health aides and certified nursing assistants. The rule is also revised to clarify training requirements for home health aides and certified nursing assistants. Requirements for cardiopulmonary resuscitation (CPR) are amended to broaden the organizations by which an instructor can be approved to provide CPR training. Excellence in Home Health (Rule 59A-8.0248)

The purpose of this workshop is to outline the process for the Excellence in Home Health Award and will prescribe the application form. The rule will implement the timeframe for award application processing including the review and approval or denial of an application and the application form. The rule will also establish standards related to patient care and satisfaction, employee retention and training, enforcement history, and Medicaid requirements. Click here to view the notice.
