Beginning November 2024, a covered entity’s obligations under the Affordable Care Act’s nondiscrimination provisions have expanded, per recently published regulations from the U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) and the Centers for Medicare & Medicaid Services (CMS).   

Join us for this 60-minute webinar to learn whether the nondiscrimination provisions of the Affordable Care Act (known as Section 1557) apply to your agency and what steps your agency must take to comply with these new regulatory requirements. Topics to be covered include conduct prohibited by Section 1557, types of health care services and provider types governed by Section 1557, and requirements of the new Section 1557 regulations such as policies and procedures, notices, multi-lingual documentation, appointment of a Section 1557 grievance coordinator, and staff training. The speakers also will discuss the status of lawsuits that have enjoined certain provisions of the new Section 1557 regulations pertaining to discrimination on the account of a patient or client’s sexual orientation.

Meet the Speakers

Lani M. Dornfeld, Esq. is a member of the law firm Brach Eichler, LLC. She practices in the firm’s Healthcare Law and Cannabis Industry practice groups. Lani’s practice focuses on a wide variety of transactional, business, and regulatory matters, including sales and purchases of healthcare businesses, strategic partnerships, joint ventures, private equity investments and transactions, HIPAA compliance, regulatory compliance, federal and state fraud and abuse laws, contract negotiations and guardianships. Lani’s clients include home health providers, hospices, hospitals, health systems, management service organizations, surgery centers, substance use disorder treatment facilities, mental health treatment facilities, dental practices, medical practices, and individual healthcare providers.

Jay Sabin, Esq. is a member of Brach Eichler’s Labor and Employment, Transportation, and Cannabis Industry practice groups. Jay’s practice focuses on workplace governance, including the regulation of the employer-employee relationship, EEO, time off, wage and hour, wage payment, occupational safety, group health and retirement benefits, executive compensation, employer successorship, post-employment covenants, reductions in force, severance, and laws governing union representation and negotiations. Jay has extensive corporate experience as in-house counsel to a regional third-party logistics provider and The New York Times.  Jay counsels employers in a broad range of industries, including health care, geriatric, and domestic care services.
