AHCA to Host RN Delegation Rulemaking Workshop on January 26

An Agency for Health Care Administration (AHCA) workshop will be held at 2:00 PM ET on Thursday, January 26 to create new rules relating to the nurse delegation legislation passed by the Florida Legislature in 2020 (HB 607) and 2022 (SB 718).

  • 59A-8.0095 – Personnel (hearing notice)
    • Clarifies training, the delegation of tasks, and supervisory requirements for home health aides and certified nursing assistants (CNAs); aligns requirements for alternate administrators with administrators and the alternate director of nursing with the director of nursing; requires submission of the license application form to report certain personnel changes.
  • Rule 59A-8.0097 – Medication Training and Validation (hearing notice)
    • Establishes training and validation requirements for home health aides and CNAs.
  • Rule 59A-8.0216 – RN Delegation of Tasks (hearing notice)
    • Establishes criteria for the delegation of tasks by a registered nurse (RN) and supervisory requirements for home health aides and CNAs.
  • 59A-8.0219 – Medication Administration (hearing notice)
    • Establishes procedures for the administration of medication by home health aides and CNAs to home health agency personnel.
