U.S. Department of Labor Issues Updated Employee Rights Posters for Employers
The U.S. Department of Labor (DOL) Wage and Hour Division (WHD) has published updated posters that employers must display in the workplace for employee awareness, effective May 2, 2023.
The required Fair Labor Standards Act (FLSA) poster reflects the amendment to the FLSA of the PUMP for Nursing Mothers Act (PUMP Act). As part of the Consolidated Appropriations Act signed into law by President Biden on December 29, 2022, the PUMP Act was enacted, which extends to more nursing mothers the right to receive break time to pump and a private place to pump at work.
To commemorate the 30th anniversary of the Family and Medical Leave Act (FMLA), the updated poster revised language in order to provide information in a way that prioritizes workers' questions and experiences.
Employers should be aware that the Equal Employment Opportunity Commission (EEOC) is updating its Know Your Rights poster in order to address the Pregnant Workers Fairness Act, which becomes effective on June 27, 2023. Those covered employers who purchase an all-in-one poster from a third-party vendor may wish to delay purchasing a new poster until the EEOC releases its updated poster in June 2023, and, in the interim, print and post the free versions of the FLSA and FMLA posters available on the WHD website.
