On Friday, December 17th, 2021, the U.S. Court of Appeals for the Sixth Circuit dissolved the Fifth Circuit's stay on the Emergency Temporary Standard (ETS) issued by the federal Occupational Safety and Health Administration (OSHA), effectively requiring all employers with 100 or more employees to ensure their workers are either fully vaccinated or submit to weekly testing and maintain mask-wearing at all times in the workplace. Following the Court's order, OSHA was quick to announce that employers now have to meet these deadlines:

  • Compliant policies must be developed by January 10, 2022
  • Testing programs must begin by February 9, 2022

Additionally, the Centers for Medicare & Medicaid Services (CMS) has been allowed to implement and enforce its Omnibus COVID-19 Health Care Staff Vaccination Interim Final Rule in 26 states, including Florida, which requires all home health agencies that are Medicare- or Medicaid-certified ensure that all staff is fully vaccinated with no testing alternative.

Experts are strongly recommending that providers don't wait to begin creating and implementing these policies! OSHA has made it very clear that they intend to begin enforcement efforts immediately.
