Early Prescription Refills Permitted Under State of Emergency for Potential Tropical Cyclone Nine
On September 24, 2024, Governor Ron DeSantis issued Executive Order 24-209, amending Executive Order 24-208, declaring a state of emergency for 63 of Florida's 67 counties in preparation for Potential Tropical Cyclone Nine. Under this state of emergency, Floridians are permitted to receive early prescription refills, including some controlled substances (excluding Schedule II drugs under Chapter 893, Florida Statutes).
The Florida Department of Health advises residents to ensure they have adequate prescriptions on hand in case pharmacies become temporarily unavailable. The Florida Office of Insurance Regulation also reminded all health insurers and managed care organizations to comply with Florida law (Section 252.358, Florida Statutes) by allowing early refills and waiving time restrictions on prescription medications. This includes disabling "refill too soon" edits and authorizing at least a 30-day supply of medication, provided authorized refills remain. This mandate is in effect until the state of emergency is lifted or expires.
