[Update] Bipartisan Legislation Introduced to Empower Contract Nurses and APRNs in Florida
Bipartisan legislation has been introduced in the Florida Legislature, aligning with HCAF's key policy priorities for the 2024 Florida Legislative Session, set to commence on January 9, 2024. SB 1798, introduced by Senator Jay Trumbull (R-Panama City), and HB 935, introduced by Representative Gallop Franklin II (D-Tallahassee), aim to address the following critical issues and enhance home health care services.
- Authorization for Contract Staff: The proposed legislation acknowledges the crucial role contract nurses play in mitigating workforce shortages and ensuring consistent patient care. Presently, restrictions limit their ability to conduct specific patient visits, creating challenges in delivering timely and flexible skilled nursing care, especially during the COVID-19 pandemic. The amendment to §400.487(5) of Florida Statutes seeks to alleviate these constraints and enhance patient care access.
- Advanced Practice Registered Nurses (APRNs): In response to the pressing health care workforce shortage, the bill addresses obstacles faced by APRNs. While progress has been made, current state law impedes APRNs from ordering home health services and obtaining Medicaid reimbursement. This contradicts federal guidelines outlined in the federal CARES Act. The proposed legislation aims to align state laws with federal provisions, enabling APRNs to provide comprehensive care to vulnerable populations.
This legislative initiative underscores Florida's commitment to fostering accessible, cost-effective, and high-quality health care.
